PRIVACY POLICY

Effective Date: [Insert Date]

Rythmizo respects the privacy of every participant and is committed to protecting the personal information shared during our educational coaching programs.

1. Information Collected

  • Contact and identification details (name, email, phone)
  • Billing and enrollment information
  • Intake form responses and coaching activity notes
  • Rythmizo explicitly does NOT collect diagnostic, medical, or psychiatric clinical records.

2. How Information Is Used

We use your data to deliver tailored coaching services, manage your membership account, improve our curriculum, and perform necessary safety screenings to ensure a supportive environment.

3. Confidentiality Limits

Because Rythmizo provides educational coaching rather than clinical therapy, HIPAA regulations do not apply. However, we strive to maintain participant confidentiality except when required by Texas law or in cases of credible threats of self-harm, harm to others, suspected child abuse, or court orders.

4. Data Security

We implement reasonable safeguards to protect your personal data. However, as no online system can guarantee absolute security, participants acknowledge the standard risks involved in using digital platforms.

5. Third-Party Services

We utilize secure third-party payment and administrative software. These providers maintain their own data policies, and Rythmizo is not liable for third-party breaches.

CONFIDENTIALITY AGREEMENT (COACHING)

Participants agree not to record coaching sessions without permission and to maintain the privacy of other members. Rythmizo will keep information strictly for coaching purposes, though absolute confidentiality cannot be guaranteed in group settings.

COMMUNITY FORUM POLICY

Our forum is an educational space for peer support. We maintain a zero-tolerance policy for harassment, bullying, or hate speech. Posts involving clinical crises or medical advice are prohibited and may lead to membership termination.

MINOR PARTICIPATION & PARENTAL CONSENT

Legal guardians must enroll participants under 18 and remain responsible for finances and safety standards. Parents confirm their authority in custody matters and understand that coaching is not a clinical therapy service.

RYTHMIZO – TERMS OF USE

Effective Date: [Insert Date]

By accessing, enrolling in, or participating in any Rythmizo services, you agree to these Terms of Use.

1. Nature of Services

Rythmizo provides educational, skills-based, DBT-informed behavioral skills instruction, emotional regulation strategies, family alignment strategies, and accountability-based coaching. Rythmizo does NOT provide therapy, psychological counseling, psychiatric services, diagnosis, crisis intervention, medical treatment, substance abuse treatment, trauma processing, or court-ordered treatment. Participation does not create a therapist–client relationship.

2. No Medical or Clinical Relationship

Services are coaching and educational only. Rythmizo is not a licensed mental health provider. Coaching is not a substitute for therapy or medical healthcare, and no medical or psychological advice is given. Clients should seek licensed mental health care when appropriate.

3. Emergency & Crisis Policy

Rythmizo does not provide crisis support. In the event of a crisis (including suicidal ideation, self-harm, threats of violence, or psychiatric emergencies), call 911, the 988 Suicide & Crisis Lifeline, or your local emergency services. Rythmizo is not responsible for emergency response.

4. Membership Structure & Billing

  • All services are membership-based and billed monthly.
  • Memberships auto-renew automatically.
  • No one-off sessions are available.
  • Fees are non-refundable, and missed sessions are not grounds for refunds.
  • Pricing may change with 30 days’ notice.

5. Cancellation Policy

Members may cancel before the next billing cycle begins. There are no partial refunds for mid-cycle cancellations. No refunds will be issued if membership is terminated due to policy violations.

6. Termination of Services

Rythmizo reserves the right to terminate membership for disruptive behavior, harassment, threats, inappropriate conduct, misrepresentation of mental health status, or if crisis-level needs require clinical care beyond our educational scope.

7. Limitation of Liability

Under Texas law, Rythmizo’s liability is limited regarding participants’ decisions, outcomes, emotional distress, and family disputes. We are not liable for indirect or consequential damages. Participation is voluntary and at the member’s own risk. Total liability is capped at the amount paid in the previous 30 days.

8. Dispute Resolution & Litigation

Texas law governs these Terms, with venue in McLennan County. Disputes must be addressed via good-faith negotiation, followed by mediation. Unresolved disputes will go to binding arbitration. Participants waive class action rights.

Confidentiality Agreement (Coaching)

Participants agree not to record sessions without permission and to respect the privacy of others by not sharing members' information or personal group stories. Rythmizo maintains reasonable confidentiality for coaching purposes but cannot guarantee other members' behavior in group settings.

Community Forum Policy

The forum is for respectful peer support only. Prohibited behaviors include harassment, hate speech, religious debates, crisis disclosures requiring clinical care, or medical advice. Rythmizo reserves the right to remove posts or terminate access if rules are violated.

Minor Participation & Parental Consent

Enrollment for minors requires parent/guardian consent and financial responsibility. Parents acknowledge coaching is not therapy. Enrolling parents confirm full legal authority to consent in custody situations.
